A court orders a newsroom to surrender its tapes, and suddenly press freedom is a burning building. Nobody asked the obvious: if those recordings are sacred, why was the interview subject never told they existed? Consent supposedly cuts both ways. Or does that only apply when the boot is on the other foot?

So the court orders tapes handed over — what stops it from demanding the notes next, and who warns the sources before they burn?
